How Missouri Law Categorizes Auto Theft Offenses
Missouri law does not use the term "grand theft auto" in its criminal statutes. Instead, offenses involving motor vehicles are charged under specific statutes covering stealing, tampering, and hijacking:
Stealing a Motor Vehicle (RSMo § 570.030)
Under Missouri law, taking a motor vehicle without the owner's consent—or through deceit or coercion—with the intent to permanently deprive them of it is an automatic felony.
- Class D Felony: Standard motor vehicle theft carries penalties of up to 7 years in prison and fines up to $10,000.
- Class C Felony: If the vehicle’s value is $25,000 or more, the charge is elevated, carrying 3 to 10 years in prison.
- Class B Felony: Repeat offenders with two or more prior stealing-related convictions in the past 10 years face 5 to 15 years in prison.
Tampering in the First Degree/"Joyriding" (RSMo § 569.080)
If the state cannot prove you intended to permanently keep the vehicle, but alleges you knowingly operated or drove it without permission, you can be charged with First-Degree Tampering—a Class D Felony carrying up to 7 years in prison.
Tampering in the Second Degree (RSMo § 569.090)
Passengers who knowingly ride in a stolen or unauthorized vehicle can be charged with Second-Degree Tampering, a Class A Misdemeanor (punishable by up to 1 year in jail), which can be elevated to a felony for repeat offenders.
Vehicle Hijacking/Carjacking (RSMo § 570.027)
Taking a vehicle directly from another person using force, coercion, or deadly weapons is charged as Vehicle Hijacking. These charges carry severe Class B or Class A Felony penalties, with potential sentences ranging from 5 to 30 years or life imprisonment.
