Misdemeanors vs Felonies

In Missouri, like in many other jurisdictions in the United States, crimes are categorized into two main types: misdemeanors and felonies. Each type encompasses a range of offenses, with different degrees or classes depending on the severity of the crime.

Misdemeanors are less serious offenses compared to felonies and are typically punishable by fines, probation, community service, or a short period of incarceration in a local jail, usually less than one year.

In Missouri, misdemeanors are further classified into four classes:

  • Class A Misdemeanor: Considered the most serious type of misdemeanor, punishable by up to one year in jail and/or a fine of up to $2,000. Examples include simple assault, theft (value less than $500), and first offense DWI (Driving While Intoxicated).
  • Class B Misdemeanor: Punishable by up to six months in jail and/or a fine of up to $1,000. Examples include first-time possession of small amounts of marijuana and trespassing.
  • Class C Misdemeanor: The least serious type of misdemeanor, punishable by up to 15 days in jail and/or a fine of up to $750. Examples include minor traffic violations and disturbing the peace.
  • Unclassified Misdemeanor: Some offenses are classified as misdemeanors but do not fit neatly into the Class A, B, or C categories. Penalties for these offenses vary.

Felonies, on the other hand, are more serious crimes and are typically punishable by imprisonment in a state correctional facility for one year or more, along with fines and other penalties.

In Missouri, felonies are categorized into several classes:

  • Class A Felony: The most serious type of felony, punishable by 30 years or life imprisonment. Examples include first-degree murder and certain drug trafficking offenses.
  • Class B Felony: Punishable by imprisonment for five to 15 years Examples include voluntary manslaughter and certain drug possession offenses.
  • Class C Felony: Punishable by imprisonment for up to 10 years. Examples include second-degree assault and certain theft offenses.
  • Class D Felony: Punishable by imprisonment for up to seven years. Examples include possession of a controlled substance and forgery.
  • Class E Felony: Punishable by imprisonment for up to four years. Examples include stalking and certain types of fraud.
