St. Louis Breath Test Refusal Lawyer

When you are driving in Missouri, under the state's implied consent laws, you are assumed to have given consent to a Breathalyzer or blood test to determine your blood alcohol content (BAC) if you are arrested. Some people choose to refuse the breath or blood test to prevent the state from obtaining potentially incriminating evidence against them. However, police may be able to take your blood without your permission if:

  • You have two prior DWIs and you refuse BAC testing
  • You are unconscious or unable to refuse to take the test
  • You have mouth injuries from an auto accident
  • Law enforcement obtains a search warrant

If you refuse a blood or breath test, your license will be taken and you will face suspension for one year if you don't challenge the stop and refusal within 15 days. For immediate legal representation, call The Hammer Law Firm at 314-266-7821.

Put a Former Prosecutor on Your Side

If you did not agree to blood testing and police took samples anyway, you need an experienced lawyer on your side who understands how to successfully attack these cases. Our firm's founding attorney Mark A. Hammer understands police procedures and the most common mistakes that are made in the collection of evidence. We will identify those errors and use them to weaken the prosecution's case against you.

If you refused to take a blood or breath test, you have 15 days to challenge the suspension of your driver's license. We may be able to get your driver's license back or set aside the suspension of your driver's license pending the outcome of the criminal case against you. If you win your criminal case, you may not lose your driver's license at all.

As a former prosecutor, our firm's founding attorney Mark A. Hammer understands how police officers and prosecutors put together DWI cases. He will use this knowledge to attack the evidence against you and weaken the prosecution's case.
